These Terms of Use ("Terms") govern your use of https://growtide.us (the "Site"), which is operated by Growtide S.A.S. ("Growtide," "we," "us," or "our"), a growth marketing agency based in Medellín, Colombia. Please read them carefully. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Who can use the Site

The Site is intended for businesses and professionals who want to learn about our services. You must be at least 18 years old to submit a form or contact us through the Site. If you use the Site on behalf of a company, you confirm that you are authorized to do so, and "you" in these Terms also refers to that company.

Use of the Site

You may use the Site for lawful purposes only. You agree not to:

Submit false, misleading, or someone else's information through our forms
Send spam, malware, or any harmful code, or try to disrupt the Site or its servers
Try to gain unauthorized access to any part of the Site or the systems behind it
Scrape, copy, or collect content or data from the Site with automated tools, except for standard search engine indexing
Use the Site in a way that violates any law or the rights of others

We may suspend or restrict access to the Site at any time, for any reason, without notice.

No guarantee of results

Marketing results depend on many factors outside our control, including your product, pricing, offer, market, competition, budget, sales process, seasonality, and changes made by advertising platforms and search engines. Any case studies, results, metrics, or examples on the Site describe past work with specific clients. They are not a promise or guarantee that you will get the same or similar results. We do not guarantee any specific outcome, such as a certain number of leads, sales, rankings, return on ad spend, or revenue.

Informational content only

Articles, guides, tools, and other content on the Site are for general information only. They are not legal, financial, tax, or accounting advice, and they may not fit your specific situation. You should consult a qualified professional before making decisions based on this content. We try to keep content accurate and up to date, but we do not promise that it is complete, current, or error-free.

Free growth audit

We may offer a free growth audit to businesses that request one through the Site. The audit is:

Non-binding. Neither you nor we have any obligation to do business together because of it.
Not a client relationship. Requesting or receiving an audit does not make you our client and does not create any agency, advisory, or fiduciary relationship.
Based on limited information. Our observations and recommendations are based on the information you give us and what we can see publicly or in any access you choose to grant. They are opinions, not guarantees.
Offered at our discretion. We may decline to provide an audit or change or end the offer at any time.

If you share access to any account (for example, an ad account or analytics property) so we can prepare the audit, you confirm that you are authorized to do so. We will use that access only to prepare the audit, and you can remove it at any time.

Client engagements

If you decide to work with us, our services will be governed by a separate written agreement signed by both parties, such as a proposal, statement of work, or services agreement. That agreement will control the scope, fees, deliverables, and other terms of our work together. If there is a conflict between these Terms and a signed agreement, the signed agreement wins.

Intellectual property

The Site and its content, including text, graphics, logos, designs, images, videos, and code, are owned by Growtide S.A.S. or our licensors and are protected by copyright, trademark, and other laws. The Growtide name and logo are our trademarks. You may view and share pages of the Site for your own non-commercial, informational use, as long as you do not change them and you keep any copyright notices. You may not otherwise copy, reproduce, modify, distribute, or create derivative works from the Site without our written permission.

Client names and logos shown on the Site belong to their respective owners and are shown with permission or for identification only.

If you send us ideas, feedback, or suggestions about the Site or our services, we may use them without any obligation to you. This does not give us any rights to your confidential business information, which we handle as described in our Privacy Policy.

Third-party links and services

The Site links to services run by other companies, including Google Calendar appointment scheduling for booking calls and WhatsApp (Meta) for chat. It may also link to other websites. These third-party services have their own terms and privacy policies, and we do not control them. We are not responsible for their content, availability, or practices, and your use of them is at your own risk.

Privacy

Our Privacy Policy explains how we collect and use personal information through the Site, including our use of cookies and how we handle text and WhatsApp messages. By using the Site, you acknowledge that we will handle your information as described in the Privacy Policy.

Disclaimer of warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any content, audit, or recommendation will meet your needs or produce any particular result.

Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, Growtide S.A.S. AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ITS CONTENT, OR THE FREE GROWTH AUDIT, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain warranties to be disclaimed or certain damages to be limited, so some of the limits above may not apply to you. This section does not limit liability that cannot be limited by law, such as liability for fraud or willful misconduct. Liability for paid services is governed by the signed agreement for those services.

Indemnification

You agree to defend, indemnify, and hold harmless Growtide S.A.S. and its owners, employees, and contractors from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of the rights of others.

Governing law and disputes

These Terms are governed by the laws of the Republic of Colombia, without regard to conflict-of-law rules. Before starting any formal proceeding, you agree to contact us at hello@growtide.us and try to resolve the issue in good faith for at least 30 days.

Nothing in these Terms takes away any rights or protections you have under the mandatory laws of the place where you live, including consumer protection laws that cannot be waived by contract. If those laws give you the right to bring a claim in your local courts or under your local law, that right is preserved.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Changes take effect when posted. If you keep using the Site after changes are posted, you accept the updated Terms.

General

Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Site. A signed client agreement governs any paid services.
Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
No waiver. If we do not enforce a provision right away, we do not give up our right to enforce it later.
Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours, for example as part of a merger or sale of our business.
Language. These Terms are available in English and Spanish. Both versions are intended to say the same thing. If there is any inconsistency, the version in the language you used on the Site will prevail to the extent required by applicable law; otherwise, the English version prevails.
